In response to the tragic 2021 collapse of Champlain Towers South in Surfside, Florida enacted Senate Bill 4-D (SB 4-D), introducing stringent safety measures for condominium and cooperative buildings. Effective statewide, this legislation mandates milestone inspections for buildings that are three or more stories in height and over 30 years in age.
A visual structural examination by a licensed architect or engineer, assessing both habitable and non-habitable areas of the building, including major structural components
Conducted if Phase One identifies substantial structural deterioration. This phase may involve invasive testing to further evaluate the extent of the deterioration.
Milestone Inspection Reports: Must be signed and sealed by the inspecting professional and submitted to the local enforcement agency. Reports should be accessible to unit owners, prospective buyers, and tenants.
The legislation also requires associations to conduct structural integrity reserve studies OR SIRS every 10 years, estimating the remaining useful life and replacement costs of major structural components. These studies aim to ensure that sufficient funds are available for future repairs and maintenance, potentially leading to increased association fees or special assessments for unit owners. This is included with a Phase ONE Milestone Inspection or can be completed by itself.
